1. Who you are contracting with

These terms govern your use of MLS Photo Connect (the "Service"), operated by Ludwig Alberty ("we", "us"). By creating an account or continuing to use the Service, you agree to these terms.

2. The Service

MLS Photo Connect lets professional real estate photographers upload property shoots, share private client galleries, collect photo selections from listing agents, and deliver finished images. Photographers each operate a private workspace; no photographer can see another photographer's clients, galleries, or data.

3. Your account

You must provide accurate information, keep your credentials confidential, and are responsible for all activity under your account. You must be of legal age to contract in your jurisdiction. If you sign up on behalf of an organization, you confirm you have authority to bind it.

4. Acceptable use

You must not:

• use the Service for any unlawful purpose, fraud, or spam;
• upload content that infringes intellectual property or privacy rights;
• probe, scan, scrape, or interfere with the security or integrity of the Service;
• upload malware or attempt to gain unauthorized access to other accounts.

5. Your content

You retain ownership of the photographs and content you upload. You grant us a limited, non-exclusive license to host, store, and process that content solely to provide the Service to you and your clients.

6. Our intellectual property

The Service, its software, design, and branding remain our property. We grant you a limited, non-exclusive, non-transferable right to use the Service in line with these terms. You may not copy, resell, redistribute, reverse engineer, or circumvent any technical limits.

7. Pricing

MLS Photo Connect is currently free to use during early access. Per-shoot payments still apply when you charge clients for an order.

8. Service availability

We work hard to keep the Service running, but we do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

9. Suspension and termination

We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated policy violations. When access ends, you may export your content for 30 days, after which it may be deleted.

10. Liability

To the fullest extent permitted by law, our aggregate liability for any claim arising from the Service is capped at the fees you paid us in the prior 12 months. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these terms excludes liability for fraud, death, or personal injury where the law does not permit it.

11. Indemnity

You agree to indemnify us against any claim arising from content you upload, unlawful use of the Service, or breach of these terms.

12. Changes

We may update these terms from time to time. Continued use after a change means you accept the updated terms.

13. Governing law

These terms are governed by the laws of the jurisdiction in which Ludwig Alberty is established. Disputes are subject to the courts of that jurisdiction.
